NEW-BYLAW

[Welland Tribune, 4 April 1872]

At a meeting of the Municipal Council of Welland Village held on the evening of Friday last, 29th instant, a BY-law was passed intuited- “A By-law for the Regulation of “ the Streets, Sidewalks and Thoroughfares of the Village of Welland, and for the Preservation of Order and the suppression of Nuisances therein,” we give, as subjoined, a brief synopsis of the provisions contained therein:

Sec. 1. Repeals by-laws previously in force respecting objects of this by-law.

2. that persons on foot, meeting on the streets shall pass to the right, or be liable to penalty if disturbance ensue.

3. that persons shall not congregate on streets so as to obstruct thoroughfares.

4. is a proviso that persons my congregate to listen to street preaching so long as they so not obstruct the walks.

5. forbids running or racing on the streets, and crowding or jostling so as to create discomfort.

6. provides that horses shall be properly harnessed and guarded to prevent run-a-ways.

7 and 8. prohibits the galloping and running at large of horses.

9. prohibits the breaking in or training of horses on the streets.

10. interdicts driving over sidewalks.

11. provides that persons wishing to drive over drains or sidewalks to their own lots, shall protect the said walks and drains from injury, by placing timber &c., beside them.

12. provides that horses and vehicles shall not be standing on the street longer than is absolutely necessary; that they shall not be left standing so as to obstruct crossings or walks, and that they may be left standing in front of the doors of those who the person in charge may have business with, only.

13. provides that vehicles shall not be left standing on the street without horses attached.

14. no person shall push carts, barrows, &c., along on the sidewalks.

15. provides that wood and coal shall not be piled so as to obstruct the sidewalks.

16. provides that no person shall sell by public auction on the streets or sidewalks without having obtained the consent of the Council.

17. prohibits the making of excavations on the surface of the street or under the walks without first having obtained permission.

18. prohibits the removing of earth from the streets without leave.

19. prohibits the making of trap-door entrances to cellars, &c., on the street of walks, without leave.

20. provides that no person shall erect or continue any awning, sign, sign post, hanging of swinging sign, which shall extend over the street or sidewalk, without the consent of the Council and Street Commissioner.

21. provides as to the mode of procedure against persons violating the two immediately preceding sections.

22. forbids climbing upon of defacing of fences and railings on streets.

23 and 24. forbid cutting down or doing injury to trees or scrubs growing on streets or in public places.

25 and 26. interdict the kindling of fires and the explosion of fire-works on streets, without authorization.

27. prohibits the throwing of stones, snow, or ice, or the using of other dangerous missiles in the street.

28. interdicts bathing in the Welland river or Canal between the hours of 7 a..m., and 9 p.m.

29. prohibits the depositing of filth or any offensive matter on the streets or commons.

The penalty for violation, it is provided, shall not exceed $50 nor six months in gaol, for each offence.
